Terms of Service

1. Acceptance of Terms
By accessing or using the OPAL Smart Integrated Platform ("OPAL SIP" or "the Platform"), operated by the Oman Energy Association ("OPAL"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Platform.
2. Description of Service
OPAL SIP is a unified digital platform serving the energy and minerals sector in the Sultanate of Oman. It provides access to OPAL services including training and certification, technical inspection, IVMS vendor management, safe journey management, and smart traffic management. Access to individual modules is granted strictly on the basis of approved service applications.
3. Account Registration & Security
You must create an account to access member services. You are responsible for the accuracy and completeness of the information you provide, and for maintaining the confidentiality of your login credentials. You agree to notify OPAL immediately of any unauthorised use of your account. You must be at least 18 years old to register.
4. User Obligations
You agree not to: (a) use the Platform for any unlawful purpose; (b) submit false, misleading, or fraudulent information, including in training, certification, inspection, or compliance records; (c) interfere with or disrupt the integrity or performance of the Platform; (d) attempt to gain unauthorised access to any account, module, or data; (e) upload viruses, malware, or other malicious code.
5. Membership & Payment
Certain services require an active OPAL membership or the payment of service fees. Applicable fees are published on the Platform and are payable in advance unless otherwise agreed. Except where required by law, fees are non-refundable once the related service has been delivered. OPAL may revise its fees with prior notice through the Platform.
6. Intellectual Property
The Platform and its content, standards, documentation, and materials are owned by OPAL or its licensors and are protected by applicable intellectual property laws. You retain ownership of the data your organisation submits. OPAL claims no ownership of your data but may process it as described in the Privacy Policy.
7. Data Privacy
Your use of the Platform is also governed by our Privacy Policy. OPAL applies reasonable technical and organisational measures to protect your data, but no system can be guaranteed to be completely secure. You remain responsible for the accuracy of the records you submit.
8. Service Availability
The Platform is provided on an "as available" basis. OPAL may suspend or restrict access for maintenance, security, or regulatory reasons, and does not warrant uninterrupted or error-free availability. Where practical, planned maintenance will be announced in advance.
9. Limitation of Liability
To the maximum extent permitted under the laws of the Sultanate of Oman, OPAL shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Platform. OPAL's total liability shall not exceed the fees you have paid in the twelve months preceding the claim.
10. Termination
OPAL may suspend or terminate your access for breach of these terms, expiry or withdrawal of membership, or where required by a competent authority. Upon termination your right to use the Platform ceases immediately. Records required for certification, inspection, or regulatory purposes may be retained in accordance with the Privacy Policy.
11. Governing Law
These terms are governed by and construed in accordance with the laws of the Sultanate of Oman. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts of Muscat.
12. Changes to Terms
OPAL reserves the right to amend these terms at any time. Material changes will be notified through the Platform or by email to the address registered on your account. Continued use of the Platform after such changes take effect constitutes acceptance of the revised terms.
